At the outset, counsel for the respondent has submitted that the High Court of Delhi while hearing the writ petition filed on behalf of the appellant, in its order dated 12.07.2023, has observed that order passed under section 14B of the EPF & MP Act, 1952 (hereinafter referred as the Act) is subject to the outcome of the writ petition, and therefore, he has made prayer that this appeal file be consigned to the record room sine-die awaiting the order of High Court in the pending writ petition.
Record perused. The writ petition bearing W.P. (C) 2640/2017 has been filed by the appellant against the issuance of the notice u/s 14B of the Act as well as scheme launched by the Ministry of Labour and Employment in the year 2017. It is further informed by the counsel that the next date of hearing before Delhi High court is 25.09.2025.
Considering the fact that the matter is still pending before this tribunal and has not come on board for the last one year due to pendency of writ petition before Delhi High Court, it is ordered that the appeal be consigned to the record room sine-die. Both parties are at liberty to revive the same after disposal of the writ petition.
