This is an appeal filed on behalf of the appellant against the order dated 28.03.2025 passed by the respondent authority u/s 14B & 7Q of the EPF & MP Act, 1952 (hereinafter referred as the Act) wherein an amount of Rs.22,17,347/-is assessed as damages and Rs.11,92,511/- as interest for the belated payment of dues made during the period 01.09.2021 to 24.11.2023.
Office has reported that the appeal has been filed beyond the prescribed period of limitation as mentioned in Rule 7 (2) of the Tribunal (Procedure) Rules, 1997. Appellant has filed a separate application for condonation of delay. Arguments on the said application heard in part.
Respondent is directed to bring entire record in respect of the dispatch of the notice as well as the communication sent through post at different occasions to the appellant for joining the enquiry. Respondent is also directed to produce the recovery file. Put up on 22.09.2025. In the meanwhile, respondent is directed not to take any coercive action till next date of hearing.
