This is a fresh appeal which is listed today for admission hearing. Appellant’s counsel has pressed his application for condonation of delay as well as misc. application filed for waiver of the pre deposit amount as mandated u/s 7O of the EPF & MP Act, 1952 (hereinafter referred as the Act).
Respondent counsel submit that he has been assigned this case yesterday only and require some time to file the reply of the applications attached with the appeal.
Case of the appellant is that he has filed an application for review u/s 7B of the Act within 45 days and the same was dismissed by the respondent vide order dated 28.03.2025. However, he had come to know about passing of this order on 10.07.2025 and received the copy of the order only on 15.07.2025 when he had moved an application to supply him the copy. Considering the above facts, there is no delay in filing the appeal, therefore, the application for condonation of delay is disposed of, believing that the appellant came to know about the said order on 10.07.2025.
