This application has been filed directly by the ld. counsel for the appellant/ applicant who wants to restore the appeal bearing no. D-2/35/2024. Along with the restoration application, a FDR of Rs. 10,00,000/- (Account no.50301195313840, HDFC Bank) is enclosed. He stated that that appellant is facing great financial difficulty and is unable to arrange the balance amount of Rs.15,00,000/- in time as given by this tribunal. However, he assured that he shall deposit the amount within four weeks from today.
Record perused. On 14.01.2025 after hearing the arguments of both the parties, this tribunal had passed conditional stay upon the impugned order whereby appellant was directed to deposit an amount of Rs. 25,00,000/- as a condition of stay within 6 weeks from today. On 17.03.2025, respondent counsel had sought more time to comply with the direction and he was accordingly granted the time for deposit of the required amount upto 01.04.2025. However, on the next date, he has failed to appear, nor any amount has been deposited with the bank as directed by this tribunal.
In the given circumstances, this application has been moved for restoration of the appeal. For showing the bonafide, he has also enclosed FDR worth Rs.10,00,000/-. He again seeks time for deposit of the remaining amount within six weeks.
Though, the ground taken by the appellant does not inspire any confidence, yet, considering the above assurance given by the ld. counsel for the appellant, application for restoration stands allowed subject to a cost of Rs.5000/- out of which Rs.2000/- is required to be paid to ld. counsel for the respondent and the rest is to be paid to DLSA. Meanwhile, if the RRC issued but is not put in effect till this time, then the same is put in abeyance. Put up for compliance of today’s order on 11.09.2025. A copy of this order be sent immediately to RPFC-Faridabad for information.
