(SIIB) of Customs, the goods covered under both the B/Es were found misdeclared in terms of quantity, value and most of the goods were not in conformity with the CDSCO certificate. A Show Cause Notice (SCN) was issued by the departmental authorities proposing for enhancement of value, confiscation of goods and imposition of penalty. The said SCN was adjudicated by the Commissioner, NS-I, JNCH vide Order-in-Original No. 32/2019-20/Commr/NS-I/JNCH dated 20.06.2019, in rejecting declared value of imported goods at Rs. 1,08,89,740/- and re-determining it to be as Rs. 1,46,64,039/-; confiscating the impugned goods under Section 111 and Section 119 of the Customs Act, 1962 and allowing these goods for redemption on payment of fine of Rs. 2,50,000/- and imposing penalty of Rs. 35,00,000/- on the appellants under Section 112(a) ibid . Besides the appellants were also imposed with a penalty of Rs. 1,00,000/-/- under Section 112(a) ibid and penalty of Rs. 10,00,000/- under Section 114AA ibid was imposed on Shri Dhananjay Desai, Director of the appellant’s company. In the said order the amount of Rs.29,04,736/- paid against challan No. 2024129468 dated 24.09.2018 was also ordered to be appropriated.
