Complaining illegal construction at the behest of the respondent nos. 6 and 7 and the failure on the part of the municipal authorities to arrest the illegal construction, the instant writ petition has been filed.

Learned advocate for the petitioners by drawing attention of this Court to the notice issued by Howrah Municipal Corporation appearing at page 23 of the writ petition dated 11^th November, 2025 would submit that the municipal authorities having noted unauthorized construction at the ground floor of premises no. 32 & 4- /1, Bijoy Kumar Mukherjee Road, P.S. Golabari, Ward No.15, Borough II, had issued a stop work notice.

The private respondent no.6 is represented. According to the learned advocate for the respondent

no.6, the construction carried out by the respondent no.6 at premises no.32, Bijoy Kumar Mukherjee Road, Howrah, is with the sanction of the municipal authorities. In support of his contention he has placed reliance on a photocopy of a sanctioned building plan, copies whereof is taken on record.

Mr. Banerjee, learned advocate appears for Howrah Municipal Corporation.

Having heard the learned advocates appearing for the respective parties and noting that a complaint has already been lodged and the municipality having already taken steps on the basis thereof and having initiated proceedings under Section 177(1) of the Howrah Municipal Corporation Act, 1980, I am of the view that the writ petition can be disposed of by directing the municipal authorities to bring such proceedings to a logical conclusion on an expeditious basis.

It is expected that the municipal authorities shall conclude the proceedings within a period of eight weeks from the date of communication of this order.

With the above observations and directions, the writ petition is disposed of.

Urgent photostat certified copy of this order, if applied for be given to the parties upon compliance with the requisite formalities.
