In this application, the petitioner has prayed for appropriate direction upon the Court below for expeditious disposal of interim maintenance application filed by her in the year 2024 and also for a direction for expeditious disposal of the main application for maintenance filed under Section 125 Cr.P.C.

It is submitted on behalf of the petitioner that in the first part of 2024, the petitioner herein/wife initiated the said proceeding under Section 125 Cr.P.C. being Misc. Case No.302 of 2024 before learned 5^th Judicial Magistrate, Howrah. The said application for interim maintenance has not yet been disposed of, though the Court has fixed several dates for hearing the said application.

Having heard learned Counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with.

Having considered the fact that the interim maintenance application had been filed by a hapless lady in the first part of 2024 and that it has not yet been disposed of and has been kept pending for 2

years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice.

In view of above, the instant application being CRR 2418 of 2026 is hereby disposed of with a direction upon the Court below to dispose of the petitioner’s prayer for interim maintenance on the next date i.e. on 9^th October, 2026 or within a period of 30 days thereafter and then to proceed with the Misc. Case filed under Section 125 Cr.P.C. as expeditiously as possible and to make his best effort to conclude the same preferably within a period of six months thereafter.
