Supplementary affidavit filed by the petitioner is taken on record. In this application, the petitioner has prayed for quashment of the proceeding in connection with G.R. Case No.243 of 2025 presently pending before learned Judicial Magistrate, 1^st Court, Barasat.

Being aggrieved by the aforesaid proceeding, learned Counsel for the petitioner submits that the present criminal proceeding is the counter-blast of the FIR lodged by the petitioner herein being G.R. Case No.212 of 2025 pending before learned Chief Judicial Magistrate, Hooghly, Chinsurah where charge sheet has also been submitted. He further submits that in the instant proceeding the entire allegation has been levelled against the husband of the de facto complainant and the present petitioner has been implicated with the only allegation that she allegedly had illicit relationship with the husband of the de facto complainant. However, during the course of investigation, the prosecution agency has failed to make out any such case against her for which she can be asked to face ordeal of trial in connection with the instant case. He further submits that although the charge-sheet speaks volumes about other accused persons, but there is hardly any reference to the role of the present petitioner along with the main conspirators. Therefore, even if the allegation levelled in the complaint are taken at

their face value and accepted in their entirety, still they do not prima facie constitute any offence to make out a case against the petitioner. He further submits that this Court while admitting CRR 3734 of 2025, has stayed all further proceeding in connection with the other two accused persons, namely, Mihir Samanta and Purnima Samanta. The present petitioner is also on the same footing.

Having heard learned Counsel for the petitioner, the application is admitted.

Petitioner is directed to serve a copy of application upon the State through the office of Public Prosecutor, High Court, Calcutta and upon opposite party no.2 through speed post intimating next date of hearing and to file affidavit of service on the returnable date.

Let the matter be listed in the Monthly List of September, 2026.

Learned Counsel for the petitioner prays for an interim relief.

Having heard learned Counsel for the petitioner and that the petitioner has made out an arguable case which requires adjudication on merit, let all further proceeding of G.R. Case No.243 of 2025 presently pending before learned Judicial Magistrate, 1^st Court, Barasat be hereby stayed qua the petitioner, namely, Anushri Pal for a period of 12 weeks or until further order, whichever is earlier.
