In this application, the petitioner has prayed for a direction upon the court below for expeditious disposal of G.R. case no. 103 of 2023 under Sections 498A/34 of the IPC, presently pending before the Learned Additional Chief Judicial Magistrate, Kalyani.

Being aggrieved by the inordinate delay in disposal of the said proceeding, learned counsel for the petitioner submits that the FIR was lodged on 19^th May, 2022 and thereafter, the Investigating agency after completion of investigation, submitted charge-sheet on 24^th June, 2022 and the court below took cognizance upon the offence on 3^rd July, 2022. Thereafter, on 6^th September, 2024 after a lapse of more than one and half years, the charge was framed against the petitioner herein and other co-accused persons under Sections 498A/34 of the IPC and the prosecution proposed to examine ten witnesses. Since then, about ten months have already been passed but not a single witness has been examined so far. Accordingly, she prayed for necessary direction upon the court below.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Having considered the fact that the matter is pending for examination of witnesses for a considerable period of time, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice.

In view of above, the instant application being CRR 1914 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the aforesaid criminal proceeding being G.R. case no. 103 of 2023 and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.
