In this application, the petitioner has prayed for expeditious disposal of the applications dated 9.1.2026, 13.1.2026 and 22.1.2026 which are pending for disposal before the trial court. In the criminal proceeding being G.R. case no. 1208 of 2025 arising out of Bidhannagar (South) Police Station case no. 216 of 2025, the Investigating Officer had filed an application under Section 107 of BNSS in connection with six bank accounts of the petitioner, Satadru Dutta. Thereafter, the petitioner made a prayer on 13.1.2026 for defreezing his six accounts, seized by police.

Learned Public Prosecutor did not raise any objection in respect of defreezing four accounts. The court below by an order dated 13.1.2026 defreezed four accounts and fixed the next date for hearing of the petitioner’s prayer for defreezing other two accounts in the presence of the Investigating Officer. In the meantime, on 22.1.2026, the petitioner challenged maintainability of the prayer made by the State under Section 107 of BNSS.

Learned counsel for the State submits that if any such direction is passed upon the court below for expeditious disposal of the said applications, in the interest of justice, the State has got no objection.

Having considered the submissions made on behalf of both the parties, it appears that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice.

In view of above, CRR 1093 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the aforesaid three prayers made by the respective parties on 9.1.2026, 13.1.2026 and 22.1.2026. and to make his best effort to conclude the hearing and to pass an order within a period of 30 days without granting any unnecessary adjournment to either of the parties.
