Learned advocate appearing for the petitioner submits that petitioner is driver of a vehicle, two of his sons are serving in the Indian Army and he be released on bail as he is innocent of the charges and has been in custody for about 500 days.

Learned advocate for the NCB opposes the prayer for bail as there has been recovery of 14,998 bottles of phensedyl.

I have taken into account the movement of the vehicle which was from Uttar Pradesh via Bardhaman to Chanditala, Hooghly and thereafter entered District of Nadia wherein the interception was made. There was continuous communications between the owner and the driver regarding the movement of the concerned vehicle.

Having regard to the fact that the petitioner was prima facie involved in the conspiracy with the owner of the vehicle and huge

quantity of recovery made in this case, I am of the view that this is not a fit case for releasing the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1676 of 2025 is rejected.

However, considering the period of detention, learned trial Court would split up the trial of the case and expedite the process.

Petitioner would be at liberty to renew his prayer of bail after the evidence of seizure list witnesses are over.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
