In Re: An application for bail under Section 483 of the BNSS, 2023. In connection with Bhagwangola P.S Case No. 267 of 2025 dated 13/06/2025 under Sections 137/140(3) of the BNS subsequently charge sheet under sections 137/140(3)/103(1)/249/3(5) of the BNS.

In the matter of: Sachin Ghosh …Petitioner. Mr. Mrityunjoy Chatterjee Ms. Suchsmita Chakraborty …for the petitioner. Mr. Gurudas Mitra Mr. Utsav Dutta …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 12 months and similarly situated as Ujjal Sk. who has been granted bail in CRM(M) 453 of 2026.

Learned advocate for the State opposes the prayer for bail and submits that there are materials to suggest the complicity of the present petitioner.

Be that as it may, records of the case reflect that the petitioner is at least similarly situated as Ujjal Sk. who has been granted bail.

Having regard to the overall circumstances and that the prosecution has relied upon 29 witnesses to prove its case, I am inclined to allow the prayer for bail of the petitioner.

Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned ACJM, Lalbagh, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date fixed before the learned Court and shall not leave the jurisdiction of District Murshidabad without the prior permission of the learned Court.

Accordingly, CRM (M) 906 of 2026 is allowed.
