Learned advocate appearing for the petitioners submit that petitioners have been falsely foisted with the present criminal case. There was already existing civil dispute as also the fact that there were differences of political opinion for which present petitioners, particularly the whole of the family has been foisted with the criminal case when an accident took place in the nearby locality.

Learned advocate appearing for the State has opposed the prayer for anticipatory bail and submitted that against some of the accused there were previous antecedents. Attention of the Court has been drawn to the seizure list as well as the FSL report.

Having regard to the overall circumstances, the factual background cannot be ruled out. So far as the complicity of the present petitioners are concerned, I find that in a generalized manner whole of the family have been implicated but the incident cannot be
