Learned advocate appearing for the petitioner submits

that the evidence of seven witnesses has been completed. Most of the witnesses are eyewitnesses to the incident. It has also been submitted that the petitioner is in custody for almost 1 year 10 months.

Learned advocate for the de facto complainant opposes the prayer for bail and submits that in front of person the victim was assaulted to death.

State has opposed the prayer for bail and submitted that

the present petitioner is solely responsible for commission of the alleged offence.

I have taken into account the evidence which has surfaced till date along with the materials of the case and is of the opinion that there was an altercation followed by scuffle and then the present petitioner with the aid of the stand of a table assaulted the deceased on his head.

Having regard to the sequence of events and the police records not reflecting any criminal antecedents so far as the present petitioner is concerned, the period of detention and without entering into the merits of the case, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner, namely, Selim Sk shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Lalbagh, Murshidabad. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Murshidabad without prior permission of the learned trial court. Petitioner shall for the next six months not enter the jurisdiction of Raninagar Police Station. After the expiry of the said period, it would be the discretion of the learned trial court either to extend the condition or waive the condition.

With the aforesaid observations, CRM(M)1513 of 2026 is

allowed.
