Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 1 year 3 months and till date, only two witnesses have been examined out of 17 witnesses cited by the prosecution. There are no convincing materials, according to the learned advocate and as such, the petitioner being a lady may be released on bail.

Learned advocate appearing for the de facto complainant opposes the prayer for bail and submits that the present petitioner is solely responsible for the alleged offence.

Learned advocate appearing for the State also opposes the prayer for bail and relies upon the post mortem report

which reflects that deceased was murdered by way of strangulation which was homicidal in nature.

Having considered that the deceased was at the bedroom and was found dead, the materials collected by the investigating agency/prosecution do prima facie establish the responsibility of the present petitioner which at this stage is difficult to be thrown out. In view of the accusations made, the complicity reflected from the prosecution papers, I am not inclined to release the petitioner on bail at this stage. As such, the prayer for bail of the petitioner is rejected .

Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record.

Mr. Gouranga Kumar Das, learned APP along with Mr. Soumya Raha, learned advocate is directed to represent the State. Their appointment may be regularised by the concerned authorities.

The application for bail, being CRM (M) 1130 of 2026, is, thus, disposed of.
