Pradip Bej Vs State of West Bengal and Ors.

The petitioner contends that his father Late Gourhari Bej retired as Head Teacher of Rambasan Primary School, P.O. Panchahari, District Purba Medinipur. The father of the petitioner died on 6^th August, 2020. The mother of the petitioner predeceased the father and died on 8^th September, 1999. The petitioner being the handicapped son of the deceased employee made an application on 18^th March, 2021 for grant of family pension. However, till date the same has not been released in favour of the petitioner. Hence this writ petition.

Mr. Dilip Kumar Sadhu, learned Advocate appearing

on behalf of the petitioner submits that the petitioner is entitled to family pension and he seeks

for appropriate direction upon the Director of Pension, Provident Fund and Group Insurance, respondent no.2 for issuance of the same.

Learned Advocate for the State also submits that direction be issued upon the concerned respondent for issuance of the family pension in favour of the petitioner.

Perused the report of the District Inspector of Schools, Purba Medinipur dated 7^th November, 2025. It is found from the aforesaid report that the respondent no.2, Director of Pension, Provident Fund and Group Insurance has returned the file to the District Inspector of Schools (PE), Purba Medinipur with a direction to comply the following objections namely (i) Correction at para ‘d’ of Part‘D’ is to be authenticated and (ii) For submission of final order passed in WPA 18332 of 2025. The District Inspector of Schools (PE), Purba Medinipur clearly mentions that the authentication as required has already been made prior to submission of file, before the Director of Pension, Provident Fund and Group Insurance. As regards the submission of order of this Court is concerned, the same can be obtained by the respondent authorities, in accordance with law. Such being the position, the objection raised by respondent no.2 does not stand to reason.

In view of the above and also considering the submissions advanced on behalf of the petitioner, the respondent no.4, the District Inspector of Schools (PE), Purba Medinipur is directed to resend the file of the petitioner to the respondent no.2, the Director of Pension, Provident Fund and Group Insurance, who shall issue the Pension Payment Order in favour of the petitioner upon verification of records, as expeditiously as possible, preferably within a period of two months from the date of communication of this order.

Accordingly, the writ petition being WPA 18332 of 2025 stands disposed of.

Learned advocate for the petitioner is directed to communicate this order to the respondent no.4, the District Inspector of Schools (PE), Purba Medinipur and respondent no.2, the Director of Pension, Provident Fund and Group Insurance for necessary action.
