By the writ petition being WPA 13194 of 2025, the order of appointment of Drawing & Disbursement Officer issued by respondent no. 6, the District Inspector of Schools (S.E.), Birbhum dated 6^th May, 2025 is challenged.

By the order dated 5^th August, 2025 following direction was issued:

“Let the newly elected managing committee and the teacher-in-charge who has proposed for approval of this newly elected managing committee appear before the board on 11^th August, 2025 with all relevant documents including fifteen days from date regarding the approval of the newly elected managing committee in accordance with law.

Learned counsel appearing for the Board is requested to place the order to be passed by Board on 25^th August, 2025.”

Pursuant to such order of this Court, respondent no. 5, the Secretary, West Bengal Board of Madrasah Education has passed order on 29^th August, 2025 rejecting the approval of the newly elected Managing Committee of Metekona Moulana Abu Taher Senior Madrasah.

Mr. Soumen Kumar Dutta, learned advocate appearing for the petitioner relying on the decision of the Hon'ble Supreme Court passed in Special Leave Petition Civil No. 5368 of 2020 seeks for a specific direction upon the Administrator to hold the election of a new Managing Committee.

Mr. Nadeem Sulaiman, learned advocate appearing for the West Bengal Madrasah Education Board submits that a considerable period to be given since the examinations of the students appearing in Alim Examination (equivalent to Madhyamik) is scheduled in the month of March, 2026.

In view of the above submissions, respondent no. 8, Jahangir Kabir, the Assistant Inspector of

Schools/Administrator is directed to conduct elections of the Managing Committee within April, 2026 and take steps for constituting the new Managing Committee in accordance with law.

With the above directions, both the writ petitions being WPA 13194 of 2025 and WPA 17159 of 2025 stand disposed of.
