Bail under Section 483, Bharatiya Nagarik Suraksha Sanhita, 2023 - High Court at Calcutta (Criminal Miscellaneous Jurisdiction), CRM (M) 1301 of 2025, decided 18.08.2025 by Bivas Pattanayak, J. - Application concerned Nakashipara Police Station Case No.152 of 2025 dated 14.02.2025 under Sections 137(2)/351(3)/87/351(2)/3(5) of the Bharatiya Nyay Sanhita, 2023 and Sections 9/6 of the POCSO Act, 2012, corresponding to POCSO Case No.29 of 2025 pending before the Special Court, POCSO Act, Krishnagar, Nadia. Perusing the case diary, the Court noted that the victim alleged kidnapping and confinement by the petitioner and his family members but was released in the police station compound by the petitioner; there were no allegations of any forcible act and the medical examination showed no notable injury; the victim stated she spoke to her family members over phone during the alleged confinement; and no complaint of wrongful confinement or kidnapping was lodged immediately thereafter - complicity therefore left to be examined in trial. With the petitioner in custody 126 days and the charge-sheet already submitted after completion of investigation, bail was granted on stringent conditions: bond of Rs.10,000/- with two like sureties (one local) to the satisfaction of the learned Judge, Special Court, POCSO Act, Krishnagar, Nadia; appearance before the trial court on each day of substantive hearing subject to S.317 CrPC, 1973 / S.355 BNSS, 2023; no intimidation of witnesses or tampering with evidence; fortnightly reporting to the Inspector-in-Charge, Nakashipara Police Station; no entry into that police station's jurisdiction except for court attendance and reporting; and furnishing of present address to the trial court, investigating officer and concerned Inspector-in-Charge. On breach of any condition the learned Trial Court may cancel bail in accordance with law without further reference to this Court. Observations confined to disposal of the application.
