Prarthana Mondal Sarkar Vs Milan Sarkar

The present petition has been filed for transfer of Matrimonial Suit No. 54 of 2023 filed by the husbandopposite party from the court of learned District Judge, District Paschim Bardhamar at Asansol to the court of competent jurisdiction of learned Additional District Judge at Rampurhat, Birbhum. It is not disputed that the petitioner wife is residing at district Birbhum.

The Court taking into account the fact that the petitioner-wife is residing at District Birbhum, which is far away from District Paschim Barddhaman and finding no perversity or mala fide in the request, the Matrimonial Suit No. 54 of 2023, pending before the learned District Judge, Paschim Barddhaman at Asansol is transferred to the learned Additional District Judge at Rampurhat, Birbhum for expeditious trial in accordance with law.

A copy of the order be sent to the trnasferor Court and the transferee Court. The transferer Court shall sent the entire record to the transferee Court within four weeks.
