Application (C.R.M. (SB) 19 of 2024) for cancellation of bail under Section 439(2) of the Code of Criminal Procedure in the matter of Sri Dilip Roy, arising out of the pending investigation in Hingalganj Police Station Case No. 229 of 2023 dated 13.10.2023 under Sections 420/406/506 of the IPC. The case diary showed the police intended to apprehend the petitioner, who had been granted anticipatory bail and, after surrender, bail by the learned court below. Having regard to the materials so collected and the prescribed punishment for which the offences have been investigated, Tirthankar Ghosh, J. (10.05.2024) was not inclined to interfere with the order granting anticipatory bail and the subsequent bail so granted, and directed — for the sake of investigation and further progress — that the opposite party meet the Investigating Officer of the case once in a fortnight till the charge-sheet is submitted before the jurisdictional court. The application was disposed of accordingly.
