The case of the petitioner is that the petitioner, as the only widowed daughter of an employee of a Government aided College, is entitled to family pension.

Learned counsel appearing for the petitioner submits that although the petitioner has other siblings but they are all married and the petitioner is entitled to family pension under a Notification dated 29.06.2006.

Learned counsel appearing for the State submits that the Notification dated 23.12.1981 makes it clear that a widowed daughter of an employee in a Government aided College is not

entitled to family pension. Counsel, however, submits that a representation made by the petitioner to the Director of Public Instruction on 14.03.2022 may be considered by the said authority.

After hearing learned counsel, this Court is of the view that the writ petition may be disposed of with a direction on the Director of Public Instruction, Government of West Bengal, being the respondent no.3 herein, to consider the representation made by the petitioner and dispose of the same by way of a reasoned order after hearing all concerned parties including the petitioner. A copy of the reasoned order shall be made available to the petitioner within a week from the date on which such reasoned order is passed.

WPA 7598 of 2022 is disposed of in terms of the above.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
