The Learned Advocate for the petitioner frankly admits that the impugned order passed under Section 23 of the Protection of Women from Domestic Violence Act is appealable under Section 29 of the said Act. The instant revision was wrongly filed. Therefore, the petitioner wants to withdraw the instant revision and craves leaves to take appropriate action on the selfsame cause of action.
The instant revision is, therefore, dismissed as withdrawn . The Learned Advocate-on-record for the petitioner is permitted to take back the certified copy of the impugned order by replacing the same with the photostat copy.
Department is directed to do the needful.
The petitioner is given liberty to take appropriate action if he is aggrieved against the order dated 21st January, 2020 passed by the Learned Additional Chief Judicial Magistrate, Lalbagh, Murshidabad in Misc. Case No. 2/2020 in accordance with law.
