The petitioner is accused of being involved in a Ponzi scam involving a huge sum of money.

According to learned counsel for the petitioner his client was a mere employee of the persons allegedly involved in the scam. The petitioner is one out of the ten accused persons. Three similarly accused persons who were also employees, have been enlarged on bail. The petitioner surrendered on 6^th April, 2022 and is in custody for 91 days.

The charge-sheet was submitted on 31^st December, 2014.

Learned counsel for the State submits that the principal accused are still absconding.

Since the charge-sheet was submitted on 31^st December, 2014, three similarly placed accused are on bail and there is nothing on record to suggest that the petitioner

will tamper with evidence or interfere with witnesses, we allow this application for bail.

The petitioner will be enlarged on bail upon furnishing a bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Special Court, Additional Sessions Judge, 1^st Court, Hooghly Sadar on the following conditions:

The petitioner shall deposit his passport with the investigating officer,

He shall report before the said officer as and when summoned,

The petitioner shall not leave the limits of Paschim Bardhaman without informing the I.C.,

¶18

He shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever,

The petitioner shall attend the court on each and every day of trial, in default, the court shall be at liberty to cancel the bail bond without any reference to this bench.

The application for bail [CRM (DB) 1713 of 2022] is, accordingly, disposed of.
