The writ petitioner claims to be a licence holder of pre1978 encroachment in respect of survey No.205/27 of an area about 250 square meters at Prothrapur village, Port Blair Tehsil, South Andaman District. The petitioner claims that a licence was granted on 2^nd August, 1989 to regularise a pre-1978 encroachment.

The petitioner could not pay the premium for recording his name as such licence holder within the time stipulated. It is further submitted that an extension of time has been granted by the Administration to all those persons who could not pay licence fee within the time stipulated.

The petitioner has applied before the Deputy

Commissioner, South Andaman district vide representation dated 9^th November, 2020 for being permitted to pay the premium, under the extended time aforesaid.

The said representation has not been considered till date.

In that view of the matter, the Deputy Commissioner, South Andaman district, Port Blair shall after strictly following all applicable rules and after ascertaining the veracity of the petitioner’s claims, pass an appropriate order on the representation of the petitioner dated 9^th November, 2020, being annexure P-2 to the writ petition.

The said representation may be considered and disposed of within a period of three months from the date of communication of a copy of this order. For the aforesaid purpose, the writ petitioner shall serve a copy of the writ petition afresh on the Deputy Commissioner while communicating this order.

With the aforesaid directions, the writ petition stands disposed of. There shall be no order as to costs.
