This public interest petition was filed in the year 2016, thereafter it was dismissed in default and has again been restored in the year 2022.

In this public interest petition the grievance raised by the petitioner is that the State authorities have illegally permitted the private respondents to fill up the water body situated at Mouza- Chak Bansberia, J.L. No.52, Dag No.104, area .830, Block-Magra Chinsurah under Police Station–Magra.

Learned counsel for the State has submitted that the respondent no.4 i.e. District Magistrate, Hooghly is the competent authority who can consider the grievance of the petitioner.

There is no recent representation by the petitioner to the respondent no.4.

Hence, we dispose of the present petition permitting the petitioner to file an appropriate detailed

representation along with the supporting material before the respondent no.4 and on receipt of the same, the respondent no.4 will duly consider the grievance of the petitioner and will also get the spot inspection done and take appropriate decision in accordance with law after giving an opportunity of hearing to all the concerned parties.

Let this exercise be completed within a period of three months from the date of receipt of the representation.

The petition is accordingly disposed of.
