the Petitioner states that during the pendency of this Petition charge-sheet was filed. He craves leave to amend the prayer clause to incorporate the details of the charge-sheet. Not objected to by Ms. Pallavi Dabholkar, learned APP and Mr. Ashish Saxena, Advocate for Respondent No. 2. In view of the no objection, leave granted to amend the prayer clause. Amendment to be carried out forthwith.

This Petition filed under 226 of the Constitution of India and Section 482 of Code of Criminal Procedure (Cr. P. C.), is preferred by the Applicants against the FIR bearing No. 228 of 2025 dated 4^th April, 2025 registered with Rabale Police Station, Navi Mumbai for offence punishable under Sections 316(2), 316(4), 318(4) and 3(5) of the BNS 2023 and RCC No. 292 of 2025 pending before Judicial Magistrate First Class, Court Room No. 7 at Belapur, Navi Mumbai.

Mr. Ashish Saxena states that the complaint filed by Respondent No. 2 against the Petitioner and was on account of misunderstanding between the Petitioner and Respondent No. 2, with respect to delivery of the goods.

Mr. Mukesh Mishra and Mr. Ashish Saxena submit that Respondent No. 2 and the Petitioner have amicably resolved the matter. They jointly tender the affidavit of settlement between the Petitioner and Respondent No. 2 affirmed by the parties on 19^th August, 2025 before Notary Mr. Sewaram Bindhyavasini Yadav. Same is taken on record and marked as ‘X-2’ for identification.

Petitioner and the Respondent No. 2 reiterate the

contents of the affidavit of settlement (X-2) and state that the matter is amicably settled, as such they pray for quashing of the impugned FIR.

Ms. Pallavi Dabholkar, learned APP for the State, submits that the Petitioner and Respondent No. 2, having settled the dispute the impugned FIR can be quashed, based on the affidavit of settlement (X-2) and the statements today made before this Court by the Advocates representing Petitioner and the Respondent No.2. She however insists for imposition of costs on the parties.

Mr. Mukesh Mishra and Mr. Ashish Saxena on instructions from the Petitioner and Respondent No.2 submit they shall pay appropriate costs.

Subject to payment of costs of Rs. 50,000/- by the Petitioner and the Respondent No. 2 as a condition precedent, this Petition is allowed in terms of prayer clause (a). Consequently, the FIR bearing No. 228 of 2025 dated 4^th April, 2025, registered at Rabale Police Station, Navi Mumbai are quashed.

Petitioner and the Respondent No. 2 shall deposit the costs of Rs.50,000/- in the below mentioned account within four

weeks from today and file affidavit of compliance along with proof of deposit in the Registry of this Court on 10^th March, 2026.
