By this Writ Petition the petitioner is taking exception to the judgment and order passed by Respondent No.5-Caste Scrutiny Committee dated 03.03.2025 by which the tribe claim of the petitioner of belonging to ‘Mannervarlu’, Scheduled Tribe has been invalidated.

It is pointed out that the same common judgment and order which is impugned in this Writ Petition was challenged by the blood relatives of the petitioner by filing Writ Petition No.9429/2025, wherein, this Court by order dated 07.08.2025 after considering the record as well as the material considered by the Caste Scrutiny Committee has granted conditional validity in favour of those validity holders.

The learned Counsel for the petitioner also invited our attention

to the order dated 12.01.2026 passed by this Court in Writ Petition

of Maharashtra and Anr. as well as in Writ Petition No.3433 of 2025 in the case of Sachin Sayabu andelwad Vs. State of Maharashtra, wherein

this Court relying on the earlier order passed by this Court in Writ Petition No.9429 of 2025 has set aside the impugned common judgement and order.

Learned AGP does not dispute the said facts nor the relationship of the petitioner with those validity holders and, therefore, we are inclined to allow this writ petition since the order which is impugned in this writ petition itself has been set aside by this Court on 07.08.2025 in Writ Petition No.9429 of 2025 and on 12.01.2026 in Writ Petition No.3431 of 2025 and Writ Petition No.3433 of 2025. Hence, the following order :-

:: O R D E R ::

(i) The Writ Petition is partly allowed.

¶25

(ii) The impugned order dated 03.03.2025, passed by Respondent No.5 Scrutiny Committee is hereby quashed and set aside.

(iii) Respondent No.5 Scrutiny Committee shall immediately issue "Mannervarlu" Scheduled Tribe validity certificates in favour of the Petitioner, which shall be subject to following conditions:-

(a) The caste validity certificates shall be subject to the outcome of the re-verification of the validity certificates of their blood

(d) The Petitioner shall cooperate with the Scrutiny Committee.
