The State of Maharashtra Through The Secretary and Others: Petitioner's vehicle (Hiwa, MH-46/BU-4252) was seized on 9.12.2025 by the Gram Revenue Officer (Talathi), Tuljapur, alleging illegal transportation of four brass Murum; a show cause notice dated 24.12.2025 was thereafter issued by the Sub Divisional Officer, Dharashiv (Respondent No.3). Present writ petition is filed with following prayer :-

“B. By issuing writ of mandamus/writ of certiorari or any other appropriate writ order or direction the Order/show cause notice dated 24.12.2025 issued by the respondent no.3 may kindly be quashed and set aside.

Mr. Kharosekar, learned advocate appearing for the

petitioner, submits that on 9.12.2025 Gram Revenue Officer (Talathi), Tuljapur seized petitioner’s vehicle Hiwa bearing registration no.MH-46/BU-4252 alleging illegal transportation of earth material (four brass Murum). Mr. Kharosekar, submits that in pursuance to aforesaid action, petitioner has been served with show cause notice dated 24.12.2025 issued by the Sub Divisional Officer, Dharashiv. Petitioner has filed reply dated 2.1.2026 alongwith royalty receipts to indicate that

petitioner was permitted to transport the minor minerals. Mr. Kharosekar submits that, although his reply is filed, till this date, no decision is taken by the Sub Divisional Officer nor petitioner is called for hearing in pursuance to show cause notice.

In light of limited controversy in this petition, present writ petition stands disposed of with directions to Respondent no.3-Sub Divisional Officer, Dharashiv to take decision within three (3) weeks on the show cause notice after considering reply submitted by petitioner alongwith supporting documents. The petitioner shall appear before the learned Sub-Divisional Officer, Dharashiv on 23.2.2026.
