PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Leslie Titus Fernandes being Executor named under the Will of deceased. The deceased namely Lionel Gerald Fernandes died at Bengaluru on 05.07.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

The deceased left behind his last Will and Testament which was duly executed at Mumbai on 30.07.2014. The said Will is in English language. The 3^rd para of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. Residuary clause in respect of properties of deceased is mentioned at last para of the Will.

Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased died issue-less. One sister of deceased namely Linda died leaving behind two sons. Deceased was survived by three brothers, one sister and two nephews. Out of them one brother is petitioner herein and all other legal heirs have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

Petitioner's oath is filed. Affidavit of Cassinno Alves and Savio Ian Viegas dated 17.01.2025 and 01.07.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 29.01.2026 is filed. All other legal formalities are complied with. Hence, petition is granted.
