Heard the learned counsels appearing for the applicant and the non-applicant at length.

By the present application, the applicant/wife is seeking transfer of Petition No.A-117/2024 instated by the non-applicant under Section 13(1) (i-a) of the Hindu Marriage Act and Petition No.D-30/2024 instituted under the provisions of Section 25 of the Guardian and Wards Act, 1890 from the file of the learned Family Court, Aurangabad to the file of the learned Family Court, Beed. It is not in dispute that on 19.02.2017 the marriage between the applicant and non-applicant was solemnized as per the customs and rites prevailing in their society at Georai, Dist. Beed. It is also not in dispute that out of the said wedlock the applicant and non-applicant are blessed with a

male child- Viransh. However, due to matrimonial dispute and due to harassment, the applicant/wife was compelled to stay at her parental house at Khandavi, Tq. Georai, Dist. Beed. She has also filed DV proceedings before the learned JMFC, Beed, however, the present non-applicant has filed the proceeding A-117/2024 seeking decree of divorce and the Petition No. D- 30/2024 seeking the custody of minor. The minor is residing with the nonapplicant within the jurisdiction of Family Court, Beed.

Therefore, considering the convenience of the applicant to attend the proceeding at Beed, it would be just and proper to transfer Petition No.A117/2024 and Petition No.D-30/2024 from the file of learned Family Court, Aurangabad and transfer it to the file of the learned Family Court, Beed.

In view of above, I am inclined to grant the present application and proceed to pass the following order:

i) MCA No.290/2025 is hereby allowed.

ii) Petition No. A-117/2024 and Petition No.D-30/2024 are hereby withdrawn from the file of learned Family Court, Aurangabad and are transferred to the file of learned Family Court, Beed.

iii) The copy of this order be communicated to both the Courts below.
