applicant/petitioner.

This is an application for withdrawal of the amount, filed by the respondent-wife. The petitioner-husband has deposited an amount of Rs.2,00,000/- with this Court in accordance with the Order dated 25.08.2025, which is an amount of maintenance pendente lite as per the Order dated 27.2.2025 passed by the Trial Court, Daryapur in H.M.P. Case No. 91/2024.

Considering the fact that the amount is towards arrears of maintenance which is to be paid to the respondent-wife, the learned counsel for the petitioner does not raise any objection for withdrawal however, subject to the result of the petition.

In view of this, civil application is allowed . The respondent-wife is permitted to withdraw the amount of Rs.2,00,000/- deposited by the petitioner-husband in this Court, subject to final result of this petition.

Having regard to the controversy being a matrimonial dispute, there are elements of settlement in the matter and the respective counsels for both the parties, on instructions, expressed their readiness to go for mediation. By consent, this Court appoints Advocate Dr. Renuka Sirpurkar, to act as a Mediator.

Accordingly, the matter is referred for mediation. Parties are directed to appear in next week before the learned Mediator by seeking prior appointment. Learned Mediator may take as many sittings as are desirable for exploring the possibility of settlement through mediation. If the settlement is arrived at, then the learned Mediator may help the parties in drafting the terms of settlement. Learned Mediator is requested to submit its report, preferably within a period of one month.
