The Applicant has filed this Application to suspend the substantive sentence awarded by the learned J.M.F.C., Court No.7, Osmanabad in R.C.C. No. 382 of 2023 by order dated 17^th May, 2025, whereby the Applicant was convicted for the offence punishable under Sections 354, 325, 452 and 506 of the Indian Penal Code and sentenced to suffer simple imprisonment for two years and a fine. The said order was confirmed by the learned Additional Sessions Judge, Osmanabad, vide judgment and order dated 20^th March, 2026, passed in Criminal Appeal No. 23 of 2025.

Heard learned counsel for the Applicant and learned A.P.P. for the State. Perused the record.

It appears that during the pendency of the Trial and Appeal, the Applicant was on bail. After the order was passed by the learned Appellate Court, he was taken into custody on the same day, and since then, the Applicant has been in jail. The learned Advocate submitted that the Applicant has deposited the fine amount with the learned Trial Court.

It further appears that the Applicant has preferred the Revision Application challenging the order passed by the learned Appellate Court, and the same is pending. Therefore, the Applicant submitted that he be released on bail, as the proceedings will take its own time to decide finally. Having considered the submissions and facts of the case, I deem it appropriate to allow the present Application.

As such, Criminal Application is allowed in terms of the prayer clause

The substantive sentence awarded by the learned J.M.F.C., Court No.7, Osmanabad in R.C.C. No. 382 of 2023 dated 17^th May, 2025, whereby convicted the Applicant for the offence punishable under Sections 354, 325, 452 and 506 of the Indian Penal Code and confirmed by the learned Additional Sessions Judge, Osmanabad vide order dated 20^th March, 2026 passed in Criminal Appeal No. 23 of 2025, are hereby suspended till the conclusion of the Revision.
