By this application, the applicants who are the investors, seek an intervention in the appeal on the ground that they are ultimate beneficiaries of the amount recovered/attached by the State under the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999. The amount of Rs.1.15 Crores, which the original applicant seeks to release, is essentially the money of the poor depositors/investors, mala fidely transferred by the accused to the original applicant. Therefore, they be permitted to intervene in the appeal.

Considering the reasons mentioned in the application, the applicants, who are the intervenors, are permitted to intervene in the appeal. Criminal Application (APPA) No. 41/2026 is allowed and disposed of accordingly.
