This petition seeks fresh / re-investigation by special agency like C.B.I. or C.I.D. under Section 173 (8) in Crime No. 332 of 2018 registered with Police Station Chakur.

The petitioner filed RCC No. 100 of 2017 seeking direction to investigate the crime by order dated 22.08.2017. Learned Magistrate directed registration of First Information Report and conducting of investigation. Pursuant to the said direction, investigation was carried out, and a "C" Summary Report was filed by the Investigating Officer. The petitioner opposed the "C" Summary Report, and accepting the objection of the petitioner, the learned Magistrate has directed further investigation.

Pursuant to the direction of further investigation, the Investigating Officer, Police Inspector, Mr. Balaji Bhande, Police Station, Chakur, who is present in the Court, is conducting the further investigation.

We asked learned APP as to whether he is the same Investigating Officer who had filed “C” Summary Report. Upon his instructions, learned APP states that he is a different Police Inspector and he is doing the investigation impartially.

In the light of the above facts and subsequent events Criminal Writ Petition has served its purpose and hence the same is, disposed of. The Investigating Officer shall complete the investigation and file appropriate report before the Trial Court.
