Writ petition disposed of finally at the admission stage by consent, with directions: (i) School Management to submit the Petitioner's case to the Education Officer (Secondary), Zilla Parishad or the Deputy Director of Education, considering the post held, within six weeks of receipt of the order; (ii) the concerned authority to conduct meticulous scrutiny of records with the School Management's assistance and give the Petitioner a hearing if the proposal is deficient; (iii) neither authority to keep the claim pending for want of authority — proposals to be transmitted between them expeditiously and decided within six weeks of receipt; (iv) Petitioner to be governed by OPS if the authority is satisfied that his initial appointment was prior to 01.11.2005 in an institution fully aided prior to that date (per Deshmukh Dilipkumar Bhagwan and Nilesh Namdev Gurav), and to consider continuity of service and condonation of any gap; (v) if found deserving, OPS benefits to be extended, no DCPS deductions from salary, and any DCPS amounts already deducted to be refunded within four weeks of the decision; (vi) GPF account to be allotted and monthly contributions permitted to be deducted and deposited therein; (vii) any rejection to be by a reasoned order; (viii) Nilesh Gurav paragraphs 13 to 18 made applicable.
