The Court held that the G.R. dated 29-03-2017 confers the 1st/2nd ACP benefits only on employees in service on 05-12-2012 with 12/24 years completed; employees retired before that date are excluded. The CEO's communication dated 22-09-2023 refusing the benefit and cancelling the order dated 30-03-2017 (in which Petitioner No.1's name was inadvertently shown at Sr.No.14) was upheld. The Co-ordinate Bench (Aurangabad) order in W.P. No.4748/2016 was distinguished as merely directional, having granted no benefits. Petition dismissed, Rule discharged, no costs.
