1. The Petition was iled in the year 2014, seeking directions for further investigation through the Criminal Investigation Department (C.I.D.) in respect of Crime No. 41 of 2010 registered under Sections 306, 506 read with 34 of the Indian Penal Code, at Ichalkaranji Police Station, District Kolhapur.

out of Gat Nos. 38, 96 & 98 and they had equal share (i.e. ¼ share each) in the aforesaid gat numbers.

3. It is alleged that there are serious lapses in the investigation into the ofence registered with Ichalkaranji Police Station, Dist. Kolhapur, vide C. R. No. 41 of 2010 under Section 306, 506 and 34 of the IPC against the accused.

4. It is brought to our notice that by the Judgment and order dated 5^th January, 2017 passed by the Trial Court the accused are acquitted for ofence under Sections 306, 506 read with Section 34 of the IPC.

5. The report indicates that the Petitioner has died during the pendency of the trial.

¶24

6. In this view of the matter, it is not possible for us to entertain the present Petition. Writ Petition is disposed of.
