The learned Labour Court-II, Aurangabad, in Application IDA No.23/2018 directed the Petitioner to pay the amount of outstanding arrears of wages to the tune of Rs.11,29,567.77 with 12% interest thereon from 01/12/1989 till March – 2025. The Petitioner has deposited the amount of Rs.45,73,206/- before the learned Labour Court. The Petitioner is disputing the final quantum of the amount. The learned Advocate for the Petitioner tenders across the bar a copy of calculation and according to the Petitioner,

In this view of the matter, the interest of justice would be met if the Applicant / Respondent is allowed to withdraw the amount, which is not disputed by the Petitioner. Hence, the following order:

ORDER

[I] Application is partly allowed.

[II] The Applicant – Respondent is permitted to withdraw the amount of Rs.22,11,555/- out of the amount deposited by the Petitioner before the learned Labour Court, subject to furnishing regular undertaking before the concerned Labour Court.

[III] The remaining amount deposited by the Petitioner be kept in Fixed Deposit till the decision of the Writ Petition, if not kept earlier.

[IV] Application stands disposed off accordingly.
