The applicant is seeking bail as he was arrested in connection with FIR No.369/2024, registered with Mukhed Police Station, District Nanded, for the offences punishable under sections 420, 406, 465, 466, 467, 468, 471, 473, 294, 507, 120-B of the Indian Penal Code.

The applicant is arrested on 12/12/2024. A charge sheet in the matter is filed on 06/02/2025. The allegation against the applicant is that, along with other co-accused, he induced various individuals by promising them

employment in the office of the Talathi and collected money in exchange for these promised posts. It is stated that the main accused is a Gazetted public servant, and at his behest, the co-accused collected money from several individuals.

The co-accused allegedly handed over the collected money to the main accused, who is identified as a Gazetted Officer, namely, the Labour Commissioner. It is further stated that Pawankumar, the main accused, assured the prospective candidates that he would secure jobs for them in exchange for money.

As per the prosecution, the present applicant received Rs.30 lakh from five individuals, including the informant. It is also mentioned that the informant himself had collected money from other candidates in a similar manner as the applicant, however, no grievance has been raised by those candidates specifically against the informant.

It is contended that the collected amount is subsequently transferred to the main accused. However, during the course of investigation, it is revealed that there is no conclusive evidence that the entire amount is transferred to the main accused. The learned Additional Public Prosecutor (APP) submits that the applicant also benefited from the illegal transactions and personally profited to the extent of Rs.12.50 lakh.

Furthermore, it is alleged that the applicant contacted the informant, gave assurances that he would secure employment for the informant’s son, and accepted Rs.20 lakh for the same. The applicant also allegedly provided a forged mark sheet indicating that the informant's son had passed the examination, following which the remaining payment was made.

A meeting was held in Mumbai involving the informant, the applicant, and the main accused, during which Rs.30 lakh was allegedly handed over to co-accused Ramdas Shinde and the applicant. During investigation, it is revealed that the informant paid Rs.1.18 lakh on 25/09/2023 and Rs.30 lakh to Ramdas Shinde.

The learned counsel for the applicant submits that the applicant is not directly involved in the commission of the crime of giving jobs. It is contended that the investigation in the present case is complete, there are no criminal antecedents against the applicant, and that even the informant, as well as the applicant, acted on the instructions of the main accused and all parties including the informant are involved in the illegal transactions.

While the offence in question is of a serious in nature and has social implications. However, considering that the investigation is complete, no antecedents exist against the applicant, and the applicant is in custody

since 12/12/2024, and the applicant having possibly acted on behalf of the main accused, this Court is inclined to grant bail to the applicant.

In view of the above, the application is allowed in the following terms: -

a] The applicant shall be released on bail in connection with FIR No.369/2024, registered with Mukhed Police Station, District Nanded, for the offences punishable under sections 420, 406, 465, 466, 467, 468, 471, 473, 294, 507, 120-B of the Indian Penal Code, on furnishing PR bond of Rs.25000/- with one or two sureties in the like amount to the satisfaction of the trial Court.

b] The applicant, upon being released on bail, shall not contact the informant, in any manner whatsoever, during the pendency of the trial.

c] The applicant shall co-operate with the trial Court and he shall attend each and every date, unless exempted by the trial Court.

¶35

d] The applicant shall not tamper with the evidence of the prosecution and he shall not influence the informant, witnesses and other persons concerned with the case.

e] The applicant, upon being released on bail, shall place on record of the trial Court the details of his Contact Number and residential address with updates in case of any change.

Needless to say, in case of violation of any of the aforesaid conditions, the bail granted to the applicant shall be liable to be cancelled.

It is also clarified that the observations made in this order are limited to the disposal of the present bail application. The concerned Court shall proceed further in the matter without being influenced by the observations made hereinabove.
