Pointing to the FIR, learned counsel for applicant submitted that present applicant is sister-in-law of deceased Mayuri, who was married with non applicant Suraj i.e. brother-in-

law of present applicant. That, due to marital discord Mayuri hanged herself on 08.12.2024. That, applicant has no concern with domestic affairs between deceased, her husband or in-laws. That, marriage is of April 2024. That, there are allegations of physical and mental cruelty. That, there are allegations that there was affair between Suraj and present applicant, but such allegations are false and there is no supportive material. That, there are also allegations of demand of money, but only against husband. That, applicant is arrested in above crime on 09.12.2024. Nothing is to be recovered or discovered from her. That, applicant is sister-in-law and has two small children. Resultanty, learned counsel prays for relief of regular bail by imposing conditions.

Learned APP opposed on the ground that barely after few months of marriage, informant’s daughter hanged herself. There are allegations that present applicant had affair with husband of deceased. That, applicant is named in the FIR. That, there are also allegations of physical and mental cruelty in the backdrop of demand of money. Hence, for above reasons, learned APP opposes the application.

Heard. Perused the FIR at the instance of father, who has reported that, his daughter Mayuri was married to Suraj in April 2024 and after it, his daughter went to cohabit with husband

and in-laws at Apsinga, Tq. Tuljapur. He has alleged that, there use to be taunting for not cooking food properly, not maintaining herself in standard manner and she was subjected to mental harassment. Father has alleged that, husband Suraj asked her to bring Rs.5,00,000/- from her father for starting laboratory. Then informant father has alleged that, after few days, they learnt from their daughter that there were illicit relations with present applicant and Suraj and she reported it on phone. On 04.12.2024 also she telephoned and informed about it and then he alleged that for not meeting of demand of Rs.5,00,000/- husband, present applicant, brother-in-law and mother-in-law subjected deceased Mayuri to cruelty as a result of which she hanged herself on 08.12.2024.

On specific query of court to the learned APP as to what has emerged during investigation against present applicant in proximity to episode of hanging dated 08.12.2024. Learned APP fairly submitted that there is no material regarding role of present applicant either on 08.12.2024 or even immediately prior to it. Therefore, taking the same into consideration and as nothing is shown to be recovered or discovered yet from applicant, who is sister-in-law having children of tender age, relief as prayed deserves to be granted. Hence, the following order is passed :-

ORDER

(i) Application is allowed.

(ii) Applicant Monali @ Dhanashri Dhiraj Gurav be released on bail in connection with Crime No. 0573 of 2024 registered with Tuljapur Police Station, District Dharashiv on executing P.B. of Rs.15,000/- with one surety in the like amount.

(iii) Applicant shall attend the concerned police station as and when called by the Investigating Officer and shall cooperate in the investigation.

(iv) Applicant shall not tamper prosecution evidence.
