This is an application for grant of regular bail under section 483 Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 in connection with crime No. 685 of 2024 registered with Shevgaon Police station, District Ahmednagar for the offences punishable under Sections 420, 406, 409 r.w. 34 of the I.P.C. and under Section 3 of the M.P.I.D. Act.

Learned advocate for the applicant pointed out the report in which it is averred that the applicant had opened an office in the name of CDC Investment Share Market Trading at Antwarwali, Tq. Shevgaon, District Ahmednagar and he had allegedly siphoned the amount of Rs.1,09,31,000/-. The applicant and the co-accused promised the depositors to return the invested amount. When the informant and other depositors demanded the invested amount, the

applicant and co-accused avoided to pay that amount. Therefore, report is lodged.

Learned advocate for the applicant submitted that the applicant is ready to deposit an amount of Rs.45,00,000/- and he is having a demand draft bearing No. 908042 dated 07.10.2025 for Rs.45,00,000/- drawn on the State Bank of India. He has tendered a photo copy of the same across the bar, which is taken on record and marked “X” for identification. The applicant has roots in the society. He will not flee away from the trial. Entire investigation is over. The trial will take a long period. It is lastly prayed to allow the application.

Learned A.P.P. for the respondent-State has strongly opposed the application and submitted that the applicant is arrested on 12.8.2024 and there is strong evidence against the applicant. If the applicant is released on bail, he will pressurize the prosecution witnesses and tamper with the evidence. Considering the serious nature of the crime, it is lastly prayed to reject the application.

Perused the charge sheet, particularly the report and the statements of witnesses. Presently, the co-accused is behind bars. The applicant has shown his bonafide intention to deposit of Rs.45,00,000/- by showing original demand draft and submitting

photo copy of the same on record, which is in the name of Registrar of this Court. The trial will take a long period. The applicant has roots in the society. He will not flee away from the trial. Considering the willingness of the applicant that he is ready to deposit Rs.45,00,000/- by way of demand draft, as stated above, the application deserves to be allowed on the principle that bail is rule and jail is exception, on certain conditions. Hence, the following order.

O R D E R

I. Application is allowed.

II. The applicant in connection with crime No. 685 of 2024 registered with Shevgaon police station, District Ahmednagar be released on bail on furnishing personal bond of Rs.50,000/with one surety of the like amount on following conditions:-

a) The applicant shall not tamper with the prosecution evidence and shall not pressurize the witnesses, in any manner.

b) The applicant to deposit the aforesaid demand draft of Rs.45,00,000/- in the Registry of this Court within two days from today and office to accept the same.
