Criminal Application No. 1833 of 2023, High Court of Bombay, Bench at Aurangabad (Coram: Smt. Vibha Kankanwadi & Rohit W. Joshi, JJ; judgment per Rohit W. Joshi, J; pronounced 29.01.2025; reserved 14.01.2025) - Under Section 482 CrPC, the applicants (original accused Nos. 1 and 2, then Police Inspector and Police Station Officer, PS Gevrai) sought quashing of the JMFC Court No. 2 Gevrai order dated 24.01.2022 (on Exhibit 7 in CMA No. 391 of 2021) directing registration of an FIR under Section 166A IPC for failure to register the informant's FIR of 21.03.2016 against Aniket Radheshyam Attal and 12 others (Sections 420, 465, 467, 468, 471, 477-A, 120B, 109 IPC), and of FIR No. 42 of 2022 dated 27.01.2022. HELD: (1) Section 166A(c) IPC is attracted only to failure to register an FIR relating to the cognizable offences specifically enumerated therein (Sections 326-A, 326-B, 354, 354-B, 370, 370-A, 376, 376-A, 376-AB, 376-B, 376-C, 376-D, 376-DA, 376-DB, 376-E, 509 IPC); the enumeration cannot be rendered superfluous; failure to register an FIR for other cognizable offences does not attract Section 166A(c). (2) Prosecution of a public servant under Section 166 IPC requires previous sanction of the State Government under Section 197 CrPC; the Explanation to Section 197(1) does not apply to Section 166. (3) The two provisos added to Section 156(3) CrPC by the Code of Criminal Procedure (Maharashtra Amendment) Act 2015 (Maharashtra Act No. 33 of 2016; in force 01.11.2016; Presidential assent 30.08.2016) bar any Magistrate's order under Section 156(3) for investigation against a public servant for official-duty acts without prior sanction, actual or deemed (90-day deeming proviso); the bar operates on the date of the Magistrate's order irrespective of the date of offence; the repugnancy plea is rejected under Article 254(2), Constitution of India; Mr. Sainath Thombre Vs. State of Maharashtra, (2018) 1 AIRBomR (Cri) 479, followed. (4) The complaint is barred by limitation: the one-year period under Section 468(1)(b)/(2) CrPC expired on 21.03.2017, the complaint being filed after a delay of over four years and three months, unexplained, and condonation not being in the interest of justice. (5) The Section 156(3) application was liable to rejection for want of a supporting affidavit and for non-recourse to Section 154(3) CrPC, per Mrs. Priyanka Srivastava, AIR 2015 SC 1758, and Babu Venkatesh, (2022) 5 SCC 639 (both relied on). GOI MHA circulars of 10.05.2013, 12.10.2015 and 06.02.2014 are not binding and do not widen Section 166A(c); Lalita Kumari, AIR 2014 SC 187, M. Karunanidhi, AIR 1979 SC 898, and Deep Chand, AIR 1959 SC 648, referred but not assistive on the points urged. The JMFC order dated 24.01.2022 and FIR No. 42 of 2022 stand quashed.
