The applicant-appellant is seeking condonation of delay of 970 days in filing the appeal.

The applicant-appellant is convicted by the judgment and order dated 15.11.2022 passed by Extra Joint District Judge and Additional Sessions Judge, Akola in Special (POCSO) Case No.62/2018, whereby the applicant/appellant is convicted and sentenced under Section 324 of the Indian Penal Code and sentenced to suffer R.I. for three years and to pay fine of Rs.5000/- in default of payment of fine, shall suffer further S.I. for three months. The applicant-appellant is also convicted under Sections 376(2) (i)(j)(1)(n) and 376 (3) of the Indian Penal Code and sentenced to suffer life imprisonment and to pay fine of Rs.1,00,000/- in default of payment of fine, shall suffer further S.I. for six months. The applicant-appellant is convicted for the offence punishable under Section 506 (II) of Indian Penal Code and sentenced to suffer rigorous imprisonment for seven years and to pay fine of Rs.5,000/-, in default of payment of fine, shall

suffer further S.I. for three months. The applicant-appellant is convicted for offence punishable under Sections 3, punishable under Section 4 of the POCSO Act and sentenced to suffer life imprisonment and to pay fine of Rs.1,00,000/- in default of payment of fine, shall suffer further S.I. for six months. The appellant is also convicted under Section 5 (k)(1) punishable under Section 6 of POCSO Act and sentenced to suffer life imprisonment and to pay fine of Rs.1,00,000/- in default of payment of fine, shall suffer further S.I. for six months.

The applicant has stated in the application that he was in jail and that, time was required for obtaining the certified copies of the record of the case, seeking advice and submitting the papers with the High Court Legal Aid Committee, Nagpur for filing the present appeal. The applicant has, thus, properly explained the delay of 970 days in filing the appeal.

Hence, we hereby condone the delay of 970 days in filing the appeal.
