Anticipatory Bail Application No.1406/2025 arises out of Crime No.0124/2025, registered with Kuntur Police Station, District Nanded, for the offences punishable under Sections 118(2), 118(1), 115(2), 352, 351(2), 189(2), 191(2), 191(3) and 191(1) of the Bharatiya Nyaya Sanhita, 2023.

2.1. Anticipatory Bail Application No.1574/2025 arises out of Crime No.0123/2025, registered with Kuntur Police Station, District Nanded, for the offences punishable under Sections 61(2), 329(3), 189(2), 191(2), 191(3), 191(1), 109, 118(1), 296, 115(2), 352 and 351(2) of the Bharatiya Nyaya Sanhita, 2023.

In the night of 03/06/2025, the Informants, witnesses and the accused persons in both CRs indulged in the quarrel in respect of the land dispute. The said land dispute was pending in the Court. Both the sides assaulted each other and the weapons, like iron rods, axes, sticks came to be used in the assault. The witnesses from both the sides sustained injuries, including grievous injuries, for which, they need to take treatment. Both the sides approached the said Police Station and lodged their respective reports and the above-referred Crimes came to be registered.

Except the Applicants in the above-referred two CRs, other accused persons are released on bail. Some on regular bail and some on anticipatory bail. The role attributed to the Applicant, Yogesh Puyad, in Anticipatory Bail Application No.1406/2025 is that, he assaulted the Informant by an iron rod on his shoulder. Similarly, Co-accused – Ramdas Puyad, to whom the role of assault on the Informant is attributed by axe, has been released on bail. As regard Applicant Nos.1, 4 and 5, in Anticipatory Bail Application No.1574/2025, is concerned, the role of assault by sticks, hands and fists is attributed to them and as far as Applicant Nos.2 and 3 is concerned, the role of assault by stones and katti, respectively is attributed to them. The papers indicate that, the weapons used in the incident have been recovered. Except for the arrest of the Applicants, the investigation is almost over. Considering these aspects of the matters, in my view, the investigation is possible without custody of the Applicants. Hence, the following order :

[I] Anticipatory Bail Applications are hereby allowed.

[II] In the event of arrest of the Applicant, namely, [1] Yogesh S/o Suresh Puyad, in Anticipatory Bail Application No.1406/2025, in connection with Crime No.0124/2025, registered with Kuntur Police Station, District Nanded, for the offences punishable under Sections 118(2), 118(1), 115(2), 352, 351(2), 189(2), 191(2), 191(3) and 191(1) of the Bharatiya Nyaya Sanhita, 2023, he shall be released on his furnishing P.B. of Rs.15,000/- (Rupees Fifteen Thousand Only), with one surety in the like amount.

In the event of arrest of the Applicants, namely, [1] Ravindra S/o Maroti Chavan, [2] Sulyabai W/o Venkatrao More, [3] Satyajit S/o Balaji Shinde, [4] Sanjay S/o. Venkatrao More, and [5] Namdev @ Raju S/o Shankar Pawar, in Anticipatory Bail Application No.1574/2025, in connection with Crime No.0123/2025, registered with Kuntur Police Station, District Nanded, for the offences punishable under Sections 61(2), 329(3), 189(2), 191(2), 191(3), 191(1), 109, 118(1), 296, 115(2), 352 and 351(2) of the Bharatiya Nyaya Sanhita, 2023, they shall be released on their furnishing P.B. of Rs.15,000/- (Rupees Fifteen Thousand Only) each, with one surety in the like amount each.

[III] The Applicant/s shall attend the concerned Police Station on 16^th , 17^th and 18^th October, 2025 between 10:00 a.m. to 02:00 p.m. and thereafter as and when called by the Investigating Officer and shall co-operate with the Investigation.
