This is an application for Anticipatory Bail.

The applicant is apprehending her arrest in Crime No.649 of 2024 registered at Panchavati Police Station District- Nashik City for the offence punishable under Section 306 of Bhartiya Nyaya Sanhita (for short “BNS”), 2023.

The applicant was working as maidservant in the house of the complainant. The allegations against the present applicant are of theft of Rs.9,600/- and gold chain of ten grams, from the house of the complainant.

I have heard the learned counsel for the applicants and the learned APP for the respondent-state.

The learned counsel for the applicant submits that applicant has nothing to do with the alleged crime. It is submitted that there are no criminal antecedents against the applicant.

The learned APP submits that custodial interrogation of the present applicant is necessary to recover the cash amount and gold chain.

I have perused the FIR. The report is lodged only on the basis of suspicion. There are no other criminal antecedents against the present applicant. Considering the overall facts and circumstances, I am inclined to release the applicant on anticipatory bail.

a] The Application is allowed.

b] In the event of arrest of the applicant in Crime No.649 of 2024 registered at Panchavati Police Station District- Nashik City for the offence punishable under Section 306 of Bhartiya Nyaya Sanhita (for short “BNS”), 2023, the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.15,000/- with one surety in the like amount;

c] The applicant shall attend concerned police station as and when called and shall cooperate in the investigation.
