1] Heard the learned counsel for the parties.

2] The learned counsel for the petitioner submits that the evidence is already taken in the case of the pillion rider and the same evidence would also be considered in the claim petition of the rider. The claim petition of the pillion rider is partly satisfied by the Tribunal.

3] It is informed that in the same accident, rider and pillion rider had expired. In the claim petition of the pillion rider, the Investigating Officer is examined during pendency of the present writ petition. The evidence, which

was considered in the claim petition of the pillion rider, can also be considered in the claim petition of the rider.
