1. On the oral prayer made by the learned counsel for the petitioner, let respondent no.3 be described appropriately. Necessary amendment shall be incorporated by the learned counsel for the petitioner during the course of the day. Reverification is dispensed with.

present in Court, has submitted that last date for submission of tender is though today midnight, however, it will be extended till 27^th February, 2024.

Let affidavit-in-reply on behalf of respondent nos.1 and 2 be filed by 22^nd February, 2024, however, a copy of the said affidavit shall be served upon the learned counsel for the petitioner by 21^st February, 2024. Rejoinder thereto, if any, may be filed by the learned counsel for the petitioner by the next date of listing.

4. Stand over to 26^th February, 2024 for admission.

5. Learned counsel for the petitioner shall give a fresh notice to the respondent no.3 along with copy of this order.

6. Before the aforesaid order could be signed, learned Addl. Government Pleader has mentioned the matter and has stated, on the basis of the instructions received from one Mr.Chandrakant Dange, CEO, Maharashtra Medical Goods Procurement Authority, who is present in court, that the subject tender will be cancelled and after re-determining the conditions, fresh tender shall be issued.

7. In the aforesaid view of the matter, the petition has been rendered infructuous, which is dismissed as such.
