states that the petitioners are permitted to withdraw their Vahivat Case No. 12 of 2012 with liberty to file appropriate civil suit for agitating the grievance of the petitioners in the said case. Hence, petitioners are granted leave to withdraw the Vahivat Case No. 12 of 2012 with liberty as prayed.

Hence, writ petition is disposed of by passing the following order:

(i) Petitioners are permitted to withdraw Vahivat Case No. 12 of 2012 filed before the Tahsildar, Niphad. Consequently, order dated 16^th September 2019 passed in Vahivat Case No. 12 of 2012 and order dated 17^th December 2020 passed in RTS Revision Application No. 172 of 2019 is rendered infructuous and hence quashed and set aside.

(ii) Petitioners are at liberty to file appropriate civil proceeding for agitating their grievance made in the said Vahivat case.

(iii) It is clarified that I have not examined the rival contention of

the parties on merits. Hence all contentions of all parties are kept open.

(iv) Writ Petition is disposed of in the above terms.
