This appeal is listed in view of a praceipe moved by the learned Counsel appearing on behalf of the appellant for urgent listing on the ground that the respondent/corporation sought to demolish the disputed construction. Accordingly, at the request of the learned Counsel for the appellant, the appeal is taken up for final hearing. After hearing the appeal, it appears that the learned trial Court has not decided the Notice of Motion No.1267 of 2024 finally. Reply to the notice of motion is yet to be filed. In view of this, the

respondent/corporation is directed to file its reply to the notice of motion within five weeks from today. After receipt of reply to the notice of motion, the learned trial Court is requested to dispose of the notice of motion finally within four weeks therafter. Till then, the parties to maintain the status quo. The appeal stands disposed of. As a sequel, the pending application also stands disposed of.
