Vistra Itcl (India) Limited Vs Reliance Capital Ltd. and 23 Ors.

1] The learned counsel for the Plaintiff, on instructions, seek permission to withdraw the Suit, in the wake of the plan being approved in the IBC proceedings before the NCLT, Mumbai. Permission is granted.

The learned counsel for the Plaintiff, however, seek liberty to invoke appropriate proceedings, in case the resolution plan is not implemented and for any reason if the implementation is failed.

The learned counsel for the Defendant has no difficulty in reserving such a liberty.

2] In the wake of above, the Suit stand disposed off as withdrawn with liberty as prayed for.

Refund of court fees, if permissible, is allowed.

3] In the wake of disposal of the Commercial suit, pending Interim Applications also stand disposed off.

4] In the wake of above, Leave Petition (L) No.9279/2020 stand disposed off.
